For what it's worth, I think an important place to start is eliminating the variable AmigoJack referred to regarding "have modified any files." Because another clue in the call stack you posted is that there isn't any $user->lang() call being made on line 794 in phpBB 3.3.4's viewtopic.php...

One of the directions you are going to have when upgrading is to delete that folder when upgrading. A fair and true point. Although I would also counter that simply saying "remember to retain your /download/ folder" also suffices, since this is as uncomplicated as any of the other folders...
