Hi all,
Some members on my forum have accidentally registered as COPPA-users, and received a form that has to be signed by their parents. As this only causes confusion I want to get rid of the COPPA agreement.
I don't know anything about US legislation, but my webhost is located in the US. My question is: am I required to enable COPPA? My forum is not commercial and doesn't have any content that could be unsuitable for children.
Please don't give me links to online law books. Just tell me if I need COPPA or not :mrgreen:

You can enable/disable it if you want. It is up to you ;)

I need to know if I'm required by U.S. law to enable it.

Not quite.

Best course is to find legal counsel, but if you have the intention of collecting information from those under the age of 13, you need to enable COPPA, along with various other things you need to check before deciding whether or not to enable COPPA.

That document is a fossil. It refers to 2001 in the future tense. It also says: 'the sliding scale will expire in April 2002.'

To be on the safe side, I have reenabled COPPA :roll:

Assuming the document was accurate in the first place, it still applies -- the law has not changed here in the USA.

Any personal information gathered about people under the age of 13 including, but not limited to, name, email address, etc, and on servers hosted in the USA, must provide a way for COPPA to be enforced. This includes companies, forums, chat rooms, email providers, etc ... anybody that collections information.

So legally, if you disable it and your server is in US jurisdiction, someone could report it to the authorities and it would have to be shut down immediately, most likely by your hosting provider.

If you'd like to get rid of it, you'd have to disallow all visitors under the age of 13 from registering.
