Copyright an Images?!

Post by enter a valid email » Sun Sep 30, 2018 10:02 am

Hi
I know just a lawyer can give me the 99,999...% right Answer but maybe someone had the same problem before.
How about the Copyright and Show Images?
1) I am in Austria not Germany! ( )
2) For example:
Image

For that I use (like everyone):

Code: Select all

To my knowledge the Site (PHP, HTML what every...) send the Information to the Client lets say the Firefox to download and show the Image:
Image
on the Place where it should go. In Germany many people mention that is a Copyright strike.
I personally would say NO because I set the Link to the Server who publish it and not download and upload it to my Server or System.

What does the owner of the image say? At the end of it it would be down to him.

Search on the net for "Facebalm Cat". ;) Its hard or impossible to ask someone.
And when some User Post some Images I cant ask someone.

I am in an Railway Forum where the Admin, Mod,... Remove EVERY Image who get posted via:

Code: Select all

I am not a lawyer, but put simply copyright is owned by the person creating the work (be it image, text or whatever)

So, if you take a photo of a cat, you own the copyright to that image. In theory anyone who wants to use that image must obtain permission for you first (whether that involves payment or not)

In practice that is hardly ever going to happen as (like you say) tracking down the copyright holder is next to impossible.

(all IMHO)

To the fact who I know about PHP, CSS, HTML,... the Owner of the Page, Domain do not do the copyright violation because he do do anything with the Picuture.

Code: Select all

<img src="https://encrypted-tbn0.gstatic.com/images?q=tbn:ANd9GcSfk83RA_Jyln8pmIHjLNM-MsyhT_UZeyqH6uIyBEnHwXEftTs7" class="postimage" alt="Image"><br>

Everything that has public permission (use as you want, with reference or whatever) by author/creator may use whatever there is. But at the end, this is the exact same thing as gdpr bs!)

This cannot be answered on an international board, since the copyright laws differ per country.

It was not about copyright, but permissions = yes/no.

If an image is copyrighted, then the need to contact you and ask to remove the image. You will NEVER get a fine for it the first time. They always need to ask first to remove it. I had this once with images from hln.be, a Belgian news site.

If an image is copyrighted, <snip>
ALL images are copyrighted for (IIRC) 75 years from the point it had been taken. You do not have to put a © or any other message on the image.

Ger is right.
Best to ask a lawyer and be prepared to pay fines when you post images (or any other foreign content).

You'll find many informations when you ask your preferred search engine with the correct keywords.

UK Copyright
Life + 70 years

If there are multiple authors, life of last surviving author + 70 years

For films, life + 70 years for the last to die of: principal director, author of screenplay, author of dialogue, or composer of music specifically created for and used in the film.

Well, if metadata are present it is.. possible. Otherwise it's hard, in fact.
